Definitions<\/span><\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Controller&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: You, the subscriber, user, or organization who determines the purposes and means of processing personal data.<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Processor&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: GroWorth, acting on behalf of the Controller in the provision of Linkedio services.<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Data Subject&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: A natural person whose personal data is processed.<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Personal Data&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: Any information relating to an identified or identifiable Data Subject.<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Processing&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: Any operation performed on Personal Data.<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-weight: bold; font-family: Calibri; font-size: 11.0pt;\">&#8220;Data Protection Laws&#8221;<\/span><span style=\"font-family: Calibri; font-size: 11.0pt;\">: Includes GDPR and any applicable privacy legislation.<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">\u00a0<\/span><\/p><p><span style=\"font-weight: bold;\">2. Subject Matter, Purpose, and Scope<\/span><\/p><p>GroWorth processes Personal Data solely to deliver Linkedio services including knowledge base management, marketing automation, analytics, and integrations with third-party platforms as outlined in the Terms of Use: <a href=\"https:\/\/groworth.io\/index.php\/terms-and-conditions\/\">https:\/\/groworth.io\/index.php\/terms-and-conditions\/<\/a>\u00a0and all related policies\/agreements.<\/p><p>This includes but are not limited to:<\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Web analytics<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">CRM and accounting integrations<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">AI-based content generation<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Social media scheduling<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Service performance analysis<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Sub-user and client relationship management<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">\u00a0<\/span><\/p><p><span style=\"font-weight: bold;\">3. Obligations of the Processor (GroWorth)<\/span><\/p><p>GroWorth shall:<\/p><ul><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Process Personal Data only in accordance with documented instructions from the Controller<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Inform the Controller if any instruction infringes applicable law<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Provide secure hosting within the EU using OVH infrastructure<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Ensure confidentiality and training of its personnel<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Support the Controller with subject access requests<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Assist the Controller in conducting data protection impact assessments<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Notify the Controller without undue delay of any Personal Data Breach<\/span><\/li><li><span style=\"font-family: Calibri; font-size: 11.0pt;\">Not sell, share, or combine Personal Data for unrelated commercial purposes<\/span><\/li><li><strong data-start=\"1963\" data-end=\"1984\">AI Disclaimer<\/strong><\/li><li>The Processor may integrate Large Language Models (LLMs) or other third-party AI systems to support features of the Linkedio service. Any data processed by such AI tools will be subject to anonymization where feasible, and the outputs are considered provisional. The Processor assumes no liability for the outcomes of such AI-based processing.<\/li><\/ul><p><span style=\"font-weight: bold;\">4. Use of Sub-Processors<\/span><\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Sub-processing is permitted only with adequate data protection terms<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">GroWorth publishes its sub-processor list and will notify Controllers before making changes<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">The Controller may object to sub-processors on reasonable legal grounds<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">5. Data Transfers<\/span><\/p><p>GroWorth hosts all data on OVH servers in the EU. If data is transferred internationally, it shall be protected by Standard Contractual Clauses or the EU-U.S. Data Privacy Framework.<\/p><p><span style=\"font-weight: bold;\">Open Source Software Usage Notice<\/span><\/p><p><span style=\"font-weight: bold;\">Use of Open Source Components<\/span><\/p><p>The Linkedio platform, provided by GroWorth Trust, incorporates and relies on open-source software components developed and maintained by third-party communities. These components are used in accordance with their respective open-source licenses, including but not limited to the MIT License, GNU General Public License (GPL), GNU Affero General Public License (AGPL), and Apache License 2.0.<\/p><p>We acknowledge the valuable contributions of these open-source communities and provide attribution as required. A complete list of open-source components used in the Linkedio platform, along with license details, is available upon request and may be published in the platform documentation or legal information section.<\/p><p><span style=\"font-weight: bold;\">Compliance with Open Source Licenses<\/span><\/p><p>GroWorth Trust commits to honoring the license terms of all open-source components included in its platform. Where required by license terms, source code and related materials are made available either through the Linkedio website or via request to legal@groworth.io. GroWorth does not assert ownership over any open-source components beyond those developed and maintained by our organization.<\/p><p><span style=\"font-weight: bold;\">Disclaimer<\/span><\/p><p>Use of open-source components is provided &#8220;as is&#8221; and without warranty of any kind. GroWorth disclaims all liability for any damages or issues arising directly or indirectly from third-party open-source components.<\/p><p><span style=\"font-weight: bold;\">6. Security<\/span><\/p><p>GroWorth maintains appropriate technical and organizational safeguards, including:<\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Data encryption (in transit and at rest)<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Regular security assessments<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Access control and audit logging<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Vulnerability management and penetration testing<\/span><\/li><\/ul><p>Details are available in our <a href=\"https:\/\/groworth.io\/index.php\/groworth\/privacy-policy\/\">Privacy Policy<\/a><\/p><p><span style=\"font-weight: bold;\">7. Rights of Data Subjects<\/span><\/p><p>GroWorth will:<\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Help Controllers respond to requests for access, correction, deletion, or data portability<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Process such requests securely and within legally required timeframes<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">8. Return or Deletion of Data<\/span><\/p><p>Upon subscription termination:<\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Personal Data will be deleted or returned to the Controller unless retention is required by law<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">9. Responsibilities of the Controller<\/span><\/p><p>The Controller shall:<\/p><ul style=\"direction: ltr; unicode-bidi: embed; margin-top: 0in; margin-bottom: 0in;\" type=\"disc\"><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Ensure that the collection and processing of data complies with applicable law<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Provide lawful instructions to GroWorth<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Inform data subjects about the processing and obtain necessary consents<\/span><\/li><li style=\"margin-top: 0; margin-bottom: 0; vertical-align: middle;\"><span style=\"font-family: Calibri; font-size: 11.0pt;\">Maintain a lawful basis for all data provided to GroWorth<\/span><\/li><\/ul><p><span style=\"font-weight: bold;\">10. Liability<\/span><\/p><p>Each party&#8217;s liability is governed by the Terms of Use. GroWorth&#8217;s liability is limited except in cases of gross negligence or willful misconduct.<\/p><p><span style=\"font-weight: bold;\">11.
