GroWorth Trust Terms of Service

Welcome to GroWorth Trust (“we,” “us,” “our”), a Public Benefit Organization (PBO) registered in South Africa (PBO Number: 930082699, Income Tax Reference No: 0845998251). These Terms of Agreement govern your interactions with GroWorth Trust including access to our website, donations, use of the Linkedio service, and related services.

By using our Website, making a donation, subscribing to our services, or accessing Linkedio, you agree to be bound by these Terms of use, our Privacy Policy, Donor Agreement, Return and Refund Policy, Data Processing Agreement, Cookie Policy and Master Services Agreement.

1. Introduction

Welcome to Linkedio, a service provided by GroWorth, a Public Benefit Organization. These Terms of Service govern your access and use of the Linkedio platform, associated services, and related applications.

By using our services, you agree to be bound by these terms, our Privacy Policy, and other referenced legal agreements.

2. Authorized Business Representation

By registering a company on the Linkedio platform, you represent and warrant that you are an authorized representative of the company you create, manage, or otherwise associate with your Linkedio account. You must have the necessary legal authority to act on behalf of such entity.

GroWorth reserves the right to immediately suspend or terminate access to the Linkedio platform if we reasonably believe that a user has misrepresented their authority or falsely claimed affiliation with a business.

By accepting these Terms, you confirm that all submitted business information is accurate and that you are legally authorized to represent the company listed under your Linkedio profile.

3. Use of the Service

You agree to use Linkedio only for lawful purposes and in accordance with these Terms. Unauthorized use, including but not limited to impersonation or misrepresentation, may result in suspension or termination.

4. Acceptance of Terms

By interacting with GroWorth Trust or its platforms, you confirm that you have read, understood, and agreed to all applicable terms. This includes service subscribers, donors, funders, third-party agents, and platform users.

 

5. Donations and Payments

Donations are accepted via fiat and cryptocurrency.

Payments are processed through PayFast, PayPal, and authorized third-party gateways.

All donations are final and non-refundable, unless a technical error is confirmed by GroWorth.

Donors will receive Section 18A tax-compliant receipts, if eligible.

6. ioToken Usage

By accepting this agreement the subscriber voluntarily donates, in-kind, unused ioTokens at the end of the monthly subscription period.

ioTokens are used within the Linkedio platform for automations and services.

Subscribers receive ioTokens for each subscription term. Annual subscription ioTokens are allocated monthly and unused ioTokens expire monthly.

Unused ioTokens expire at the end of each subscription period and are voluntarily automatically donated, in-kind, to the Micro Enterprise ioToken Pool.

Donated ioTokens do not represent a refund, carry-forward, or any retained rights to benefits.

Top-Up ioTokens are non-refundable and do not expire while the subscription is active.

7. Donor and Funder Participation

Donors and funders consent to their data being collected, processed, and stored in the EU in compliance with GDPR.

Donors may request anonymity, opt out of communications, or restrict usage of their data.

8. Data Privacy and Processing

All personal and customer data is processed under the GroWorth Privacy Policy.

Data is securely hosted in the European Union via OVH.

Use of third-party AI services such as LLMs is integral to Linkedio, and Customer Data may be transmitted via secure APIs to these services for automation, transformation, and enrichment.

 

9. Third-Party Users and Agencies

Agencies and third-party service providers may manage services on behalf of their clients through the Linkedio platform.

These parties are responsible for ensuring proper authorization and consent from their clients in accordance with privacy and data laws.

10. Open Source Software Usage Notice

Use of Open Source Components
The Linkedio platform, provided by GroWorth Trust, incorporates and relies on open-source software components developed and maintained by third-party communities. These components are used in accordance with their respective open-source licenses, including but not limited to the MIT License, GNU General Public License (GPL), GNU Affero General Public License (AGPL), and Apache License 2.0.
We acknowledge the valuable contributions of these open-source communities and provide attribution as required. A complete list of open-source components used in the Linkedio platform, along with license details, is available upon request and may be published in the platform documentation or legal information section.

Compliance with Open Source Licenses
GroWorth Trust commits to honoring the license terms of all open-source components included in its platform. Where required by license terms, source code and related materials are made available either through the Linkedio website or via request to legal@groworth.io. GroWorth does not assert ownership over any open-source components beyond those developed and maintained by our organization.

Disclaimer
Use of open-source components is provided “as is” and without warranty of any kind. GroWorth disclaims all liability for any damages or issues arising directly or indirectly from third-party open-source components.

11. Limitation of Liability and Disclaimer

1. No Warranty of Service.
Linkedio is provided by GroWorth Trust on an “as-is” and “as-available” basis. We do not warrant that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. Beta Version and Service Evolution.
The Linkedio platform is currently offered in BETA testing version. The features, integrations, and service capabilities are still under development and subject to change without notice. By registering and using the service, you accept that:

• You are participating in a testing environment, and some functionalities may be unstable or incomplete;
• We take no responsibility for any decisions or outcomes resulting from the use of the service during this phase;
• You may delete your account and associated data at any time through your user profile;
• You are encouraged to submit feedback to help improve the platform.

3. Use of AI-Generated Content.Linkedio integrates multiple third-party Large Language Models (LLMs) and artificial intelligence tools to assist with content generation, automation, and analytics. Any outputs produced by these services—such as copywriting, recommendations, summaries, or business plans—are to be treated as non-final drafts or works in progress.
We make no warranties as to the accuracy, legality, reliability, or completeness of any AI-generated content. You assume full responsibility for reviewing and validating all content before use. GroWorth Trust shall not be liable for any losses or damages arising from the use or reliance on such outputs.

4. Limitation of Liability.
To the fullest extent permitted under applicable law, GroWorth Trust, its trustees, staff, volunteers, contractors, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential or exemplary damages;
• Any loss of profits, goodwill, use, data, or other intangible losses;
• Any liability exceeding ZAR 1,000, regardless of the form of action.

This limitation applies whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damages.

5. Jurisdiction-Specific Exceptions.
If the above limitation of liability is not enforceable under the laws applicable in your jurisdiction, GroWorth Trust’s liability shall be limited to the maximum extent permitted by such law.

12. Refunds and Cancellations

All payments, Top-Up ioTokens, and donations are final and non-refundable.

Subscription cancellations are permitted at any time, but no partial refunds apply.

ioTokens from cancelled subscriptions follow the standard expiration and donation rule.

13. Security

All user data is encrypted in transit and at rest.

Security breaches that materially affect user data will be disclosed with appropriate remediation steps.

14. Legal Jurisdiction

These Terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Johannesburg.

 

15. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.

Any dispute, controversy or claim arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall first be resolved through good faith discussions between the parties. Failing such resolution, the dispute shall be submitted to and finally resolved by binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in accordance with its rules in force at the time of the dispute.

• The seat of arbitration shall be Johannesburg, South Africa.

• The arbitration shall be conducted in English.

• The decision of the arbitrator(s) shall be final and binding.

This clause is consistent with the dispute resolution mechanism used in the Volunteer Agreement and applies equally to Micro Enterprises benefiting from the Linkedio service.

You also agree that your use of the Linkedio service is subject to the following agreements, which are hereby incorporated by reference:

• Terms of Service
• Privacy Policy
• Master Services Agreement
• Data Processing Agreement
• Cookie Policy
• Donor Agreement
• Return and Refund Policy

By using the Linkedio service, you acknowledge and confirm that you are bound by the terms of these agreements.

15. Binding Agreement by Use or Submission

By submitting any application (including volunteer, donor, micro enterprise, or service provider applications), or by registering, accessing, using, or benefiting from the GroWorth or Linkedio services in any form, you irrevocably agree to the terms of the applicable online agreements published by GroWorth Trust. These include, but are not limited to the agreements listed in clause 14. Governing Law and Dispute Resolution.

Your continued access to any service, platform, or opportunity provided by GroWorth constitutes legal acceptance of all such terms and any amendments posted thereafter. If you do not agree to any of these terms, you must not engage with or benefit from our services.

 

16. Modifications

GroWorth reserves the right to update or modify these Terms at any time. Continued use of the service after updates constitutes acceptance of the revised Terms.
